Urgent Assistance Required: Forced Resignation and Contractual Violations
陳情內容
Dear Ministry of Labor, I am writing to formally file a complaint regarding my current employer's actions, which I believe violate my rights under labor laws in Taiwan. My name is Urooj Murad and I have been employed at Juntou International School Nantou for over a year , and I am facing significant issues regarding the termination of my employment. The key points I would like to highlight are as follows: Forced Resignation: My employer has been pressuring me to resign instead of accepting a termination notice. I was warned that if I choose termination, the termination date will be set intentionally to disadvantage me. I was told that resigning would allow my departure to take effect immediately, but termination would remain dated as January 9, 2025, leaving me with no viable options. Violation of Contract Terms : My employment contract clearly states that I am entitled to a 30-day notice period in the event of termination, as I have been employed at this institution for more than one year. However, I have not received any written notice of termination, nor have I been granted the 30-day notice period stipulated in my contract. Impact on Immigration and Visa Status: I had informed my principal, Mr. Howard, in advance of my plans to travel from January 10 to February 7, 2025, utilizing a combination of Chinese New Year leave, annual leave, and unpaid leave. However, my employer has scheduled the termination date as January 9, 2025, intentionally jeopardizing my ability to apply for a job-seeking visa. This visa is a benefit I am entitled to as a graduate of a Taiwanese university. I have contacted the immigration office, and they confirmed that this termination date would prevent me from re-entering Taiwan after my planned trip. The actions of my employer have caused immense stress and financial uncertainty. termination date appears to have been intentionally set to create obstacles for me, both professionally and personally. I kindly request your intervention to: - Ensure my employer follows proper labor laws, including providing the required 30-day notice for termination. - Investigate the coercion I am facing to resign under pressure. - Protect my rights as a foreign resident and employee in Taiwan. - Give me enogh time to renew my ARC upon my return or before leaving for my trip, I can't cancel my trip as it's my sister's wedding and I am visiting my family after 3 years. I would appreciate your guidance on how to proceed further. Please let me know if additional documentation is required to support my case. Thank you for your time and support. Sincerely, Urooj Murad
